End User License Agreement

Read carefully before installing or using the Software. By installing, copying or using Max IEC Gateway you agree to this End User License Agreement.

1. Grant of license

Subject to this EULA, Max Energic Apps ("Maxenergic", "we") grants you a non-exclusive, non-transferable license to install and use Max IEC Gateway (the "Software") on one (1) computer at a time owned or controlled by you, and to make one (1) backup copy. You may move the license to another computer by releasing the previous one.

2. License types

2.1 Trial license

The trial permits evaluation for thirty (30) days in sessions of fifteen (15) minutes. It is for evaluation only and may not be used in production.

2.2 Commercial license

A commercial license removes the trial restrictions and permits:

  • unlimited session duration;
  • production use;
  • activation on one (1) computer at a time;
  • all future updates at no extra cost (lifetime free updates);
  • email technical support.

3. Restrictions

You may NOT:

  • copy or duplicate the Software except as expressly permitted;
  • modify, translate, adapt or create derivative works;
  • reverse engineer, disassemble or decompile the Software, except where the law allows it;
  • rent, lease, lend, sell or sublicense the Software;
  • remove, alter or obscure proprietary notices;
  • use the Software for any unlawful purpose;
  • transfer the license without prior written consent;
  • use the Software on more computers than licensed;
  • circumvent or disable license verification.

4. License verification

The Software includes license verification that binds the license to specific computers and periodically verifies it online. It may stop protocol conversion if the license is invalid or verification fails for more than thirty (30) days. Internet access is required for activation.

5. Intellectual property

The Software is protected by copyright and other intellectual-property laws. We retain all rights, title and interest in the Software. This EULA grants no rights to trademarks or service marks.

6. Third-party components

The IEC 60870-5-101/104 protocol implementation in the Software is Max Energic's own. The Software also includes the following third-party components, each licensed under its own permissive open-source license; none of them is licensed under the GPL or LGPL:

  • MIT License: NModbus 3.0.81; the Microsoft .NET runtime and the Microsoft.Extensions.*, Microsoft.EntityFrameworkCore.Sqlite 8.0, System.IO.Ports, System.Management, System.Memory and System.ServiceProcess.ServiceController packages; Bootstrap 5.3.3, Chart.js 4.4.7 and chartjs-adapter-date-fns 3.0.0 (web interface).
  • Apache License 2.0: Serilog 4.1.0 and its hosting, settings, console and file packages; SQLitePCLRaw 2.1.6.
  • Public domain: SQLite (bundled through SQLitePCLRaw).

The full copyright and license notices are in the file THIRD-PARTY-NOTICES.txt installed with the Software. Your rights under those licenses for the respective components are not limited by this EULA.

7. Updates and support

Your commercial license includes all future updates of the Software at no extra cost. We may change or discontinue features in future versions; this does not affect your right to keep using a version you already have.

8. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF RESULTS AND UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR FOR LOSS OF PROFITS, DATA, BUSINESS OR GOODWILL. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SOFTWARE. Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Industrial use warning

The Software converts industrial communication protocols. You acknowledge that it must be tested before production use, that you are responsible for configuration, safety measures and network security, that it is NOT designed for safety-critical or life-support applications, and that a failure could disrupt operations or damage equipment.

11. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with it. On termination you must stop using the Software and delete all copies.

12. Export compliance

You agree to comply with applicable export laws and not to export or re-export the Software to any prohibited country or person.

13. Governing law

This EULA is governed by the laws of the jurisdiction in which Maxenergic operates, without regard to conflict-of-law principles.

14. Entire agreement and severability

This EULA, together with the Terms of Service, is the entire agreement about the Software. If a provision is unenforceable, the rest remains in effect.
